Does State Registration of your trademark make sense?

There are States that offer registration of your trademark, but the benefits are often negligible. Depending upon the protections afforded under the state statute, you may decide to opt for federal protection instead.
Recognize the difference between filing your corporate name under the Corporation Act of the State and a trademark registration. Filing Articles of Incorporation creates the corporate entity pursuant to State authority, which includes the right to use the selected name, subject to federal trademark rights. These rights do not substitute for the rights that accrue upon registration of your trademark.
